Informal resolution first
Before filing a claim, you agree to send a written dispute notice to grayskyes@solenterprises.org with your name, account, contact information, issue, requested relief, and supporting facts. The parties will attempt informal resolution for thirty days.
Binding arbitration
Unless prohibited by law or opted out where allowed, disputes arising from the services or these terms will be resolved by binding individual arbitration rather than court, except for small claims court matters, IP enforcement, injunctive relief, collections, or claims that cannot legally be arbitrated.
Class action waiver
To the fullest extent permitted by law, disputes must be brought only in an individual capacity and not as a plaintiff or class member in a class, consolidated, collective, representative, or private attorney general action.
Venue
Where court action is permitted, the parties consent to courts located in Arizona, United States, unless a mandatory consumer law requires another forum.
Injunctive relief
Either party may seek injunctive or equitable relief to prevent unauthorized use of IP, data misuse, security harm, confidentiality breaches, or service abuse.
Attorney fees
The prevailing party in a collection, IP, confidentiality, or terms-enforcement action may recover reasonable costs and attorney fees where allowed.
